ORDINANCE NO. 123
Section 1: Amended Provisions: Section 1: ACTIVITIES PROHIBITED WITHIN CEMETERIES BY ORDINANCE NO. 102 ENTITLED AN ORDINANCE ESTABLISHING RULES AND REGULATIONS GOVERNING ENTRY INTO AND ACTIVITIES UPON THE GROUNDS OF CEMETERIES LOCATED IN MENARD COUNTY ILLINOIS UNDER THE JURISDICTION OF THE MENARD COUNTY CEMETERY MAINTENANCE DISTRICT, MENARD COUNTY, ILLINOIS shall be amended by adding the following sub paragraphs to Section 1:
R. All interments of any king shall be done by contract only. All contracts will be for the remains of one person. Interment of more than one person on a lot is allowed but each shall be done by a separate contract.
S. All interments of any kind shall have an outer burial container (vault). A vault for a full casket burial shall be made of concrete or steel or of plastic sufficient to withstand the weight of the earth and equipment passing over it. All cremations shall have a vault made of plastic sufficient to withstand the weight of the earth and equipment passing over it.
T. All persons signing a Contract shall establish they have the right to do so in accordance with the Disposition of Human Remains Act. No dumping of human cremains is allowed and if so done, local law enforcement shall be notified.
U. In the event a marker or headstone needs to be moved because it was placed in the wrong location the Maintenance District has the right to move it. Any marker or headstone that has to be moved for an interment will be put back in place by the Maintenance District as soon as it is deemed safe to do so.
V. Only law enforcement and those conducting military rites shall be allowed to carry firearms or any kind of a weapon on any cemetery grounds.
W. All vehicles shall remain on roadways and park in designated areas. The speed limit of 20 mph shall be observed at all times. All vehicles shall yield to maintenance crews and vehicles.
X. All persons shall conduct themselves in a manner that maintains the peace and dignity of the cemetery.
Section 2: VIOLATIONS. Any person or entity that shall violate the provisions of Ordinance No. 102 and this Amending Ordinance shall be guilty of a misdemeanor and upon conviction shall be fined in an amount not exceeding $500.00 for each violation. Each day in which any such violation shall continue shall be deemed a separate offense.
Section 3: Effect of Amending Provisions: All of the remaining provisions of Ordinance No. 102 shall be and remain in effect except as otherwise altered or changed by this Amending Ordinance.
Section 4: INVALIDITY. The invalidity of any section, clause, sentence or provision of this Ordinance shall not affect the validity of any other part of this Ordinance which can be given effect without such invalid part or parts.
Section 5: EFFECTIVE DATE. This Ordinance shall be in full force and effect from and after its passage, approval, recording and publication as provided by law.
PASSED AND APPROVED pursuant to the roll call vote by the Board of Trustees of the Menard County Cemetery District on this _____13th___ day of March A.D. 2013.
